Client's digital agreement for coaching services

Welcome to The Senses Consulting Ltd. (“we,” “our,” “us”, “the coach”).

This agreement is made between The Senses Consulting Ltd.  and the client (“client”, “you”) on the day that the client confirms their booking for our coaching services (“coaching”, “services”) as listed on our website thesensecompany.com.

1. Digital Agreement

By booking a session or multiple coaching sessions, and making payment, you acknowledge that you are entering into a binding digital agreement with The Senses Consulting Ltd. This agreement does not require a physical signature to be valid. Your completion of the booking process and payment signifies your acceptance of these terms and conditions as outlined in this agreement.

2. Coaching Relationship

Coaching is a collaborative process that fosters a partnership between the Client and Coach. Together, they develop and implement a forward-looking coaching agenda aimed at helping the Client gain new insights, establish new behaviors and achieve specific goals. Both the Client and Coach agree to engage fully in this experience, acknowledging that coaching is distinct from therapy, counseling, or consulting.

3. Confidentiality

The Coach commits to maintaining the privacy and confidentiality of all conversations and information shared by the Client, as permitted by law. No personal information will be disclosed to any third party without the Client’s explicit consent. Exceptions may occur in cases where there is an imminent risk of serious harm to the Client or others.

4. Coaching Commitments &Results

By entering into this relationship, the Client and Coach acknowledge that the Client desires to make positive changes or improvements in various aspects of their life. Such changes often take time to implement and sustain. The pace of progress is uncertain and varies among individuals. As such, the Client and Coach agree that while the Coach will provide support and guidance, the results achieved are dependent on the Client’s individual efforts, circumstances, and commitment to the coaching process. The Coach cannot guarantee any specific outcomes or results. The Client understands that they should not expect any specific results and agrees not to hold the Coach liable for any lack of results.

5. Session Format and Cancellation Policy

Coaching sessions may be conducted in person, by phone, via video conference, through email, or by other means of communication as specified in the coaching offer. 

The Coach and Client agree to adhere to scheduled appointment times and to begin and conclude all sessions punctually.

If the Client is more than 10 minutes late, the Coach will consider the appointment canceled, and the Client will be responsible for the full coaching fee. Conversely, if the Coach is more than 10 minutes late, the Client may treat the session as canceled and will not be liable for any payment for that session.

The Client agrees to cancel or reschedule an appointment at least 48 hours in advance without incurring a change fee. Any cancellations or changes made within 48 hours will incur a 50% cancellation fee. Please note that this policy may vary on a case-by-case basis.

6.Coaching Fees

All prices for coaching services are outlined on the respective page of our website and may also be communicated through special announcements, such as via email or other forms of communication. Payment must be made in full prior to any coaching sessions. All payments are strictly non-refundable. For longer coaching packages, split payment options may be offered and will be specified accordingly.

7. Limitation of Liability

The Coach shall not be liable for any direct, indirect, incidental, or consequential damages arising from the coaching relationship, including but not limited to any loss of profits or personal injury, except in cases of gross negligence or willful misconduct. The Client acknowledges that they are responsible for their own decisions and outcomes resulting from the coaching services.

8. Client-Initiated Termination

If the Client wishes to terminate the coaching services before the completion of the coaching package, they must provide written notice to the Coach. Any remaining sessions in the coaching package will be forfeited upon termination. All payments made for the coaching services are strictly non-refundable, regardless of the Client’s decision to end the coaching.

9. Coach-Initiated Termination

The Coach reserves the right to terminate this agreement at any time, with written notice to the Client. Reasons for termination may include but are not limited to the Client’s lack of engagement, failure to comply with the terms of this agreement, or any behavior deemed inappropriate by the Coach. Upon termination, any outstanding fees for services rendered up to the date of termination shall be payable. All payments made are strictly non-refundable.

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong.
